1. Acceptance of Terms

By accessing and using RentPager, a service provided by NewRosetta Inc ("we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.

2. Service Description

RentPager provides property management tools including:

  • Automated rent reminder notifications via SMS
  • Payment tracking and monitoring
  • Property and renter management
  • Bank account integration via secure, compliant data aggregator

3. SMS and Communication Consent

By using RentPager, you explicitly consent to:

  • Receive automated SMS messages and alerts from RentPager
  • Allow RentPager to send SMS notifications to your renters on your behalf
  • Receive service-related communications via email and SMS

Message and data rates may apply. You can opt-out of non-essential communications at any time by contacting support or updating your account settings.

4. Renter Consent

When you add a renter to RentPager, you confirm that:

  • You have obtained the renter's consent to receive SMS notifications
  • The renter agrees to receive automated rent reminders and payment notifications
  • The renter's contact information is accurate and up-to-date

5. Bank Account Integration

RentPager uses a secure, compliant data aggregator to connect to your bank account. By connecting your bank account, you understand and agree that:

  • We only review transactions to verify if expected rent payments have been received in the specified amounts
  • We do not access, store, or review any other financial information or transactions
  • We do not have the ability to move, transfer, or withdraw funds from your account
  • Your banking credentials are securely handled by our data aggregator and never stored by RentPager

We are committed to protecting your financial privacy. Monitoring rent payments is our sole purpose for bank account integration - that's not our business, and we respect your privacy.

6. User Responsibilities

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations
  • Use the service only for lawful purposes
  • Obtain proper consent from renters before adding them to the platform

7. Limitation of Liability

RentPager is provided "as is" without warranties of any kind. NewRosetta Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

8. Third-Party Service Providers

RentPager relies on trusted third-party service providers to deliver our services. These include, but are not limited to: cloud infrastructure, payment processing, banking integrations, SMS delivery, email services, AI providers, and identity verification services.

8.1 Our Vendor Due Diligence

We take security seriously. Before partnering with any third-party provider, we conduct thorough due diligence including:

  • Requesting and reviewing SOC 2 Type II compliance reports
  • Evaluating security certifications (ISO 27001, PCI-DSS where applicable)
  • Reviewing privacy policies and data handling practices
  • Assessing incident response and breach notification procedures
  • Conducting ongoing monitoring and periodic security reviews

8.2 Limitation of Liability for Third-Party Breaches

IMPORTANT DISCLAIMER:

  • No liability for third-party breaches. While we carefully vet our service providers, NewRosetta Inc is not liable for any data breaches, security incidents, service disruptions, or damages arising from the actions, omissions, or failures of third-party service providers.
  • Inherited risk. By using RentPager, you acknowledge that your data may be processed by third-party providers and that security incidents at those providers are outside of our direct control.
  • Notification commitment. In the event we become aware of a security incident at a third-party provider that may affect your data, we will promptly notify you and provide guidance on recommended actions.

8.3 Your Responsibility

You are responsible for maintaining the security of your own account credentials and for promptly notifying us if you suspect any unauthorized access. We recommend enabling all available security features and regularly reviewing your account activity.

$9. Subscription Terms (Landlord Pro)

Landlord Pro Subscription: The following terms apply to our paid subscription service:

8.1 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Your subscription automatically renews unless canceled before the renewal date
  • All payments are processed securely through Stripe
  • Prices are in USD unless otherwise specified

8.2 Cancellation

  • You may cancel your subscription at any time through your account settings
  • Upon cancellation, you retain access to Pro features until the end of your current billing period
  • After your subscription ends, your account will revert to the free Landlord plan
  • Your data remains accessible, but some features may become limited

8.3 Refunds

  • We do not offer refunds for partial subscription periods
  • If you believe you were charged in error, please contact support within 14 days
  • Refunds for billing errors will be processed at our discretion

8.4 Price Changes

  • We may change subscription prices with 30 days advance notice
  • Price changes will not affect your current billing period
  • Continued use after a price change constitutes acceptance of the new price

8.5 Service Level (Priority Support)

  • Pro subscribers receive priority support with a 48-hour target response time
  • Response times are targets, not guarantees, and exclude weekends and holidays
  • Support is provided via our in-app ticket system for Pro subscribers

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the service. Continued use of RentPager after such modifications constitutes acceptance of the updated terms.

11. Australian Consumer Law

For Australian Users:

If you are a consumer in Australia, you may have certain rights under the Australian Consumer Law (ACL) that cannot be excluded, restricted, or modified by these Terms. Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee or other right you may have under the ACL.

Consumer Guarantees

Under the ACL, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services remedied if they fail to meet consumer guarantees.

Privacy Act 1988

We comply with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). Please see our Privacy Policy for details on how we collect, use, and protect your personal information, including your rights to access and correct your data.

Governing Law

For Australian users, these Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of RentPager.

12. Artificial Intelligence Services (Abby AI)

RentPager offers an AI-powered assistant called "Abby AI" to help landlords manage their properties. By using Abby AI or any AI-powered features within RentPager, you acknowledge and agree to the following terms:

11.1 Third-Party AI Providers

  • Abby AI is powered by multiple third-party Large Language Models (LLMs) accessed through Vercel AI Gateway
  • AI providers may include, but are not limited to: OpenAI (GPT), Anthropic (Claude), Google (Gemini), and other providers
  • RentPager reserves the right to change AI providers at any time without notice to improve service quality
  • RentPager does not control or operate the underlying AI models and is not responsible for their outputs

11.2 Data Processing and Training

IMPORTANT DATA NOTICE:

  • Data sharing with AI providers. When you use Abby AI, your prompts and conversation data may be transmitted to third-party AI providers for processing.
  • Potential use for training. Third-party AI providers may use anonymized or aggregated conversation data to improve their models and services, subject to their respective privacy policies.
  • Enhanced context. To provide more accurate and helpful responses, we may include additional context from your RentPager account (property details, tenant information, payment data) in AI requests.
  • No guarantee of privacy. While we take reasonable measures to protect your data, you should not share highly sensitive personal information (SSNs, bank passwords, etc.) with Abby AI.

11.3 Limitation of Liability for AI Services

DISCLAIMER OF LIABILITY:

  • AI outputs are not professional advice. Abby AI provides general information and suggestions only. Responses should not be considered legal, financial, tax, or professional advice.
  • No guarantee of accuracy. AI-generated responses may contain errors, inaccuracies, or outdated information. Always verify important information independently.
  • No liability for AI outputs. NewRosetta Inc shall not be held liable for any damages, losses, or consequences arising from actions taken based on AI-generated advice or information.
  • Hallucinations and errors. AI models may generate plausible-sounding but incorrect or fabricated information ("hallucinations"). You are responsible for verifying all AI outputs before acting on them.
  • Third-party provider actions. We are not liable for any data breaches, service disruptions, or policy changes by our third-party AI providers.

11.4 Usage Limits and Fair Use

  • AI services are subject to daily usage limits which vary by subscription plan
  • Free users receive limited AI interactions per day; Landlord Pro subscribers receive higher limits
  • Usage limits reset daily at midnight UTC
  • Unused interactions do not roll over to subsequent days

11.5 Abuse Prevention and Automated Traffic

ANTI-ABUSE POLICY:

  • Automated traffic prohibited. You may not use automated scripts, bots, or programmatic methods to interact with Abby AI without express written permission.
  • DDoS and abuse detection. RentPager monitors for unusual traffic patterns, rapid-fire requests, and other indicators of automated or abusive usage.
  • Account restrictions. If RentPager determines, in its sole discretion, that your account exhibits unnatural traffic patterns or potential abuse (even if unintentional), we reserve the right to:
    • Temporarily or permanently limit your access to AI features
    • Suspend or terminate your account
    • Require verification or justification before restoring access
  • Premium users included. These policies apply equally to all users, regardless of subscription tier. Paying for a premium subscription does not exempt you from anti-abuse policies.
  • No refunds for abuse violations. If your account is restricted due to abuse detection, you are not entitled to refunds for any paid subscription periods affected.

11.6 Prohibited Uses

  • Using AI services to generate illegal, harmful, discriminatory, or unethical content
  • Attempting to extract, reverse-engineer, or abuse the underlying AI models
  • Using AI outputs to harass, deceive, or harm tenants or other parties
  • Reselling or commercially redistributing AI-generated content without permission
  • Circumventing usage limits through multiple accounts or other means

11.7 Changes to AI Services

RentPager reserves the right to modify, suspend, or discontinue AI services at any time without notice. This includes changing AI providers, adjusting usage limits, modifying features, or discontinuing the service entirely. Continued use of AI services after changes constitutes acceptance of those changes.

12. Third-Party Verification Services

RentPager offers optional identity verification services for tenant screening purposes. By using these services, you acknowledge and agree to the following:

12.1 Stripe Identity

  • Identity verification is performed by Stripe, Inc. ("Stripe"), a third-party payment and verification provider
  • RentPager does not conduct identity verification directly; we facilitate access to Stripe's verification services
  • Tenant identity documents and selfie images are processed and temporarily stored by Stripe in accordance with their privacy policy
  • Verification results (verified, failed, requires input) are shared with RentPager to display status to landlords

12.2 Verification Fees

  • Identity verification is a paid, one-time service charged per verification request
  • Landlord Pro subscribers pay a reduced rate for verification services
  • Payment is required before a verification request can be initiated
  • Fees are non-refundable once a verification session has been created, regardless of outcome

12.3 Limitation of Liability for Verification Services

IMPORTANT DISCLAIMER:

  • RentPager is not an identity verification provider. We facilitate access to third-party verification services.
  • No guarantee of accuracy. We do not warrant or guarantee the accuracy, completeness, or reliability of any verification result provided by Stripe or any other third-party provider.
  • No liability for verification errors. NewRosetta Inc shall not be held liable for any damages, losses, or consequences arising from incorrect, incomplete, or failed identity verifications performed by third-party providers.
  • Landlord responsibility. Landlords are solely responsible for their tenant selection decisions. Verification results should be used as one factor among many in evaluating prospective tenants.
  • Compliance responsibility. Landlords must ensure their use of verification services complies with all applicable fair housing laws, anti-discrimination laws, and tenant screening regulations in their jurisdiction.

12.4 Remediation

  • If you believe a verification result is incorrect, you may contact RentPager support
  • We will, to the best of our ability, work with Stripe to investigate and resolve verification issues for paying customers
  • Resolution of verification disputes is subject to Stripe's policies and procedures
  • We cannot guarantee any specific outcome or timeline for dispute resolution

12.5 Data Handling

  • Verified identity document images may be stored in your RentPager document hub for your records
  • These documents are visible only to you (the landlord) and are not shared with other parties
  • You may delete verification documents from your document hub at any time
  • Stripe retains verification data according to their data retention policies

12.6 Future Services

RentPager may offer additional tenant screening services in the future, including credit checks and background checks. These services will be provided through third-party partners and will be subject to similar terms regarding liability and data handling. Additional terms may apply and will be presented before use.
